By registering for and using Elanita Medical, you agree to these Terms of Service. Please read them carefully. These terms constitute a binding agreement between you (the practice) and Elanita Systems (Pty) Ltd.

Elanita Medical is a cloud-based practice management platform operated by Elanita Systems (Pty) Ltd, a company registered in South Africa.

To use Elanita you must:

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@elanita.co.za if you suspect any unauthorised access.

Each practice account is independent. You may not share accounts between practices or use one account to manage multiple unrelated practices without our written consent.

4. Subscription and Payment

Free trial

New practices receive a 14-day free trial. No credit card is required to start. At the end of the trial, you must select a paid plan to continue using the platform.

Paid plans

Paid subscriptions are billed monthly on your anniversary date (the date of your first payment). Prices are as published on our pricing page and may be updated with 30 days' notice.

Payment

All practices are billed in ZAR via Paystack, which supports local debit cards, credit cards, EFT, Apple Pay, and Capitec Pay. Payment details are handled securely by Paystack and are never stored on our servers.

Late payment and suspension

If payment is not received by the due date, your account will be marked overdue. After 16 days overdue, your account will be suspended and access to the platform will be restricted until the outstanding balance is settled.

Cancellation

You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.

You agree to use Elanita only for lawful purposes and in accordance with these Terms. You must not:

As a practice using Elanita, you are the responsible party for all patient data you enter into the platform. You are responsible for:

Elanita Medical acts as the operator processing data on your behalf. We will process patient data only as directed by you and as described in our Privacy Policy.

7. AI Features

Elanita includes AI-powered voice transcription for consultation notes. By using this feature:

Elanita Medical accepts no liability for clinical errors arising from reliance on AI-generated content without appropriate clinical review.

8. Intellectual Property

All software, design, and content comprising the Elanita platform is owned by Elanita Systems (Pty) Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for your practice.

Your practice data — patient records, consultation notes, invoices — remains yours. We do not claim ownership of your data.

9. Availability and Uptime

We aim to keep Elanita available 24/7 but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from temporary unavailability.

To the maximum extent permitted by law, Elanita Systems (Pty) Ltd shall not be liable for:

We reserve the right to suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the platform in a manner that puts other users or patient data at risk. We will provide notice where reasonably possible.

Upon termination, you may request an export of your practice data within 90 days. After this period, data will be permanently deleted.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
